By accessing or using CBJ & Co., you agree to these Terms. If you do not agree with these Terms, please do not use our website or purchase products through CBJ & Co. These Buyer Terms apply specifically to customers and shoppers. Sellers are subject to separate Seller Terms and Conditions.

1. About CBJ & Co.

CBJ & Co. is an online marketplace that connects shoppers with independent sellers. Independent sellers may offer products through their individual stores on the CBJ & Co. marketplace. When you purchase a product, the product may be supplied and fulfilled by the independent seller offering that product. CBJ & Co. provides the marketplace platform and related services but does not manufacture or necessarily supply the products listed by independent sellers.

2. Eligibility

You must be legally capable of entering into a binding agreement to use CBJ & Co. and make purchases through the marketplace. If you are under the age required to enter into contracts in your jurisdiction, you may only use CBJ & Co. with the involvement and permission of a parent or legal guardian where permitted by law. By using CBJ & Co., you confirm that the information you provide is accurate and that you have the authority to enter into these Terms.

3. Customer Accounts

Some features of CBJ & Co. may require you to create a customer account. You are responsible for:

• Providing accurate and current information
• Keeping your account information up to date
• Keeping your login information confidential
• Maintaining the security of your account
• All activity that occurs through your account

You must notify CBJ & Co. if you believe your account has been accessed without authorization. You may not create an account using another person’s identity or information, impersonate another person, or provide false or misleading information. CBJ & Co. may suspend or terminate an account that violates these Terms or applicable policies.

4. Using CBJ & Co.

You agree to use CBJ & Co. only for lawful purposes and in accordance with these Terms. You must not use CBJ & Co. to:

• Commit fraud or engage in deceptive activity
• Provide false or misleading information
• Impersonate another person
• Attempt to gain unauthorized access to another person’s account
• Interfere with the operation or security of the website
• Upload malicious software or harmful code
• Scrape or collect marketplace information through unauthorized methods
• Harass, threaten, or abuse sellers, customers, or CBJ & Co. personnel
• Manipulate reviews or ratings
• Use the marketplace for unlawful transactions
• Circumvent marketplace security measures or restrictions

CBJ & Co. may investigate activity that appears to violate these Terms.

5. Products and Independent Sellers

Products available through CBJ & Co. may be offered by independent sellers. Each seller is responsible for the products they offer, including applicable product descriptions, pricing, inventory, fulfillment, shipping, and customer service. CBJ & Co. may review products and listings and may remove or restrict products that violate our policies or applicable law. Before making a purchase, you should review the product information and any applicable seller information.

6. Product Information

Sellers are responsible for providing accurate information about their products. Product photographs may not always appear exactly as they do in person because of photography, lighting, display settings, or other factors. Product availability, colours, sizes, materials, measurements, descriptions, and other details may change. If you have questions about a product before purchasing it, you should contact the seller or CBJ & Co., as appropriate.

7. Purchases

When you place an order through CBJ & Co., you may be entering into a transaction with the independent seller offering the product. Before completing your purchase, you should review:

• The product description
• Product price
• Applicable taxes
• Shipping charges
• Delivery information
• Seller information
• Return and refund information
• Any other applicable terms

The checkout process will provide applicable purchase information before you complete your order. For applicable Ontario Internet agreements, consumers must have an opportunity to accept or decline the agreement and correct errors immediately before entering into it. Ontario law also requires certain purchase information to be disclosed before the agreement is entered into.

8. Prices and Taxes

Product prices will be displayed on the marketplace. Applicable taxes, shipping charges, and other charges will be shown during the purchasing process where required. Prices and availability may change before an order is completed. The price applicable to your purchase will be the price presented during the applicable checkout process, subject to applicable law.

9. Payments

Payments may be processed through third-party payment providers. You agree to provide accurate and complete payment and billing information when required. CBJ & Co. does not guarantee that every payment method will always be available. Third-party payment providers may have their own terms and privacy policies. You are responsible for ensuring that you are authorized to use the payment method provided.

10. Order Confirmation

After placing an order, you may receive an order confirmation by email or through your customer account. An order confirmation acknowledges that your order has been received. An order may be cancelled or unavailable in certain circumstances, including product availability, payment issues, suspected fraud, pricing errors, or other circumstances permitted by law. If an order cannot be fulfilled, you will be notified and any applicable refund will be handled in accordance with the applicable terms and law.

11. Shipping and Delivery

Products may be shipped by individual sellers or their selected shipping providers. Shipping costs and available shipping methods may vary depending on the seller, product, destination, and shipping method. Estimated delivery times are estimates and are not necessarily guaranteed delivery dates. You are responsible for providing accurate shipping information when placing an order. 12. Returns, Refunds, Exchanges, and Cancellations

Returns, refunds, exchanges, and cancellations are subject to the applicable seller’s policies, CBJ & Co.’s Returns and Refunds Policy, and applicable law. There is not necessarily a general legal right to return or exchange goods simply because you change your mind; applicable rights can depend on the transaction and circumstances. Nothing in these Terms is intended to remove or limit any consumer rights that cannot legally be excluded or waived. 13. Damaged, Incorrect, or Missing Orders

If you receive a product that is damaged, incorrect, incomplete, or otherwise different from what you ordered, please contact the seller or CBJ & Co. as soon as reasonably possible. You may be asked to provide information about the issue, including photographs or order information, so that the matter can be reviewed. Any available remedy will be determined according to the applicable seller policy, CBJ & Co. policies, and applicable law.

14. Reviews and Ratings

Where reviews or ratings are available, they should reflect your genuine experience with a product or transaction. You must not:

• Submit fake reviews
• Review a product you did not purchase or experience where the review system requires a genuine purchase
• Create multiple accounts to manipulate ratings
• Submit reviews on behalf of another person without authorization
• Threaten or harass another user through reviews
• Use reviews to provide false or misleading information

CBJ & Co. may remove reviews that violate these Terms or applicable policies.

15. Customer Communications

You may receive communications relating to:

• Your account
• Orders
• Payments
• Shipping
• Returns or refunds
• Customer support
• Security
• Changes to the marketplace
• Other important service matters

These communications may be sent even if you have unsubscribed from marketing communications. Marketing communications will be handled in accordance with applicable law and our Privacy Policy.

16. User Content

CBJ & Co. may allow customers to submit content such as:

• Reviews
• Ratings
• Questions
• Comments
• Messages
• Photographs
• Other materials

You are responsible for content you submit. You must have the necessary rights and permissions to submit the content. You must not submit content that is:

• False or misleading
• Fraudulent
• Illegal
• Defamatory
• Harassing
• Threatening
• Abusive
• Infringing
• Malicious
• Discriminatory
• Intended to interfere with the marketplace

CBJ & Co. may remove content that violates these Terms or our policies.

17. Intellectual Property

The CBJ & Co. website, including its logo, branding, design, graphics, text, layout, and original content, may be protected by intellectual property laws. You may not copy, reproduce, modify, distribute, sell, or commercially exploit CBJ & Co. content without appropriate authorization. Product photographs, descriptions, logos, trademarks, and other seller content may belong to the respective sellers or other rights holders.

18. Third-Party Services

CBJ & Co. may use third-party services such as payment processors, shipping providers, website hosting providers, analytics services, and other technology providers. These third parties may have their own terms and privacy policies. CBJ & Co. is not responsible for third-party websites or services that we do not operate or control.

19. Marketplace Availability

We will make reasonable efforts to keep CBJ & Co. available and functioning properly. However, the website or certain features may occasionally be unavailable because of:

• Technical problems
• Security issues
• Hosting problems
• Third-party service interruptions
• Events outside our reasonable control

CBJ & Co. does not guarantee that the marketplace will always be available, uninterrupted, secure, or error-free.

CBJ & Co. may suspend or terminate your customer account if you:

• Violate another CBJ & Co. policy
• Engage in fraudulent or unlawful activity
• Create a security risk
• Misuse the marketplace
• Attempt to manipulate marketplace activity
• Engage in abusive or threatening conduct

Where appropriate, CBJ & Co. may also restrict your ability to make purchases or use certain marketplace features. Nothing in this section limits any rights you may have under applicable law.

21. Disclaimer

To the extent permitted by applicable law, CBJ & Co. provides the marketplace on an “as available” basis. CBJ & Co. does not guarantee that:

• The website will always be available
• The website will always be error-free
• Product information supplied by sellers will always be complete or accurate
• Every product will remain available
• Every seller will fulfill every order
• Third-party services will operate without interruption

Nothing in these Terms excludes or limits a legal right or protection that cannot lawfully be excluded or limited.

22. Limitation of Liability

To the maximum extent permitted by applicable law, CBJ & Co. will not be responsible for losses or damages that cannot legally be excluded or limited. CBJ & Co. is not responsible for the acts, omissions, products, services, representations, or conduct of independent sellers or other third parties, except where responsibility cannot legally be excluded. Nothing in these Terms limits liability where doing so would be prohibited by applicable law.

23. Privacy

Your use of CBJ & Co. is also subject to our Privacy Policy. Our Privacy Policy explains how we collect, use, protect, and disclose personal information. Please review the Privacy Policy before creating an account or making a purchase.

24. Changes to These Terms

CBJ & Co. may update these Buyer Terms of Use from time to time. When changes are made, we will update the Last Updated date at the top of this page. Where required by law, we will provide appropriate notice or obtain any required consent.

25. Governing Law

These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada, without regard to conflict-of-law principles. You agree that applicable courts located in Ontario will have jurisdiction over disputes relating to these Terms, subject to any mandatory rights or requirements provided by applicable law. If CBJ & Co.’s legal location changes in the future, this section should be reviewed and updated as appropriate.
